Warranty & Refunds Policy – Hardwick Heavy Machinery
1. Introduction
This Warranty & Refunds Policy sets out the rights and obligations of customers who purchase machinery, parts, or accessories from Hardwick Heavy Machinery.
It operates in accordance with the Australian Consumer Law (ACL) contained in the Competition and Consumer Act 2010 (Cth).
2. Australian Consumer Law (ACL) Rights
Under the ACL, customers are entitled to:
- A replacement or refund for a major failure; and
- Compensation for any other reasonably foreseeable loss or damage; and
- Repair or replacement if the goods fail to be of acceptable quality but the failure does not amount to a major failure.
This policy is in addition to those statutory rights.
3. Standard Warranty
- All new products purchased from Hardwick Heavy Machinery include a 12-month (1 year) standard warranty from the date of purchase.
- During this period, if a product is found to be defective due to a manufacturing fault or material defect, we will provide a free replacement or repair.
- Warranty claims must be made in writing and accompanied by proof of purchase (invoice or receipt).
4. Warranty Exclusions
This warranty does not cover damage, failure, or defects caused by:
- Misuse, neglect, or improper operation.
- Failure to follow operating instructions or maintenance requirements.
- Accidental damage, human error, or environmental conditions beyond normal use.
- Unauthorised repairs, modifications, or alterations.
- Consumables, wear-and-tear parts, or routine maintenance.
5. Refunds
Refunds will only be provided where:
- The product has a major defect that is not due to misuse, human error, or improper installation; or
- The product is unsafe or significantly different from its description; or
- Repairs or replacements cannot be provided within a reasonable time.
Refunds will not be offered where the issue is due to:
- Change of mind.
- Incorrect product selection by the customer.
- Customer negligence, misuse, or accidental damage.
6. Process for Claims
- Contact us within 3 days of identifying the fault.
- Provide proof of purchase and a written description of the issue.
- Where required, return the product to our premises or an authorised service centre (freight arrangements will be discussed at the time of claim).
- We will assess the product and advise whether the claim is covered under the ACL and/or our warranty.
7. Remedies
- If the issue is confirmed as a manufacturing defect within the warranty period, we will provide a free replacement or repair.
- If the defect constitutes a major failure, you may elect to receive a refund or replacement.
- If the issue is outside the warranty or excluded under this policy, repairs or replacements may be offered at the customer’s cost.
